Macrossans Lawyers have decades of experience in defending and prosecuting workers' compensation claims and matters under the Workplace Health and Safety legislation.

We manage over 100 WorkCover claims each year, which includes lodging claims with WorkCover Queensland and providing advice to clients on legal aspects of accepted and rejected claims and applications for review. Our lawyers are experienced in prosecuting and responding to claims for damages arising from work-related injuries, both where the claims are made by employees under the WorkCover Queensland Act or other claimants under the Personal Injuries Proceedings Act. We appear regularly in the Industrial Magistrates Court and Queensland Industrial Relations Commission - with up to 18 appeals on callover every month.

Our services include:

  • Conducting legal audits to identify workplace safety and compliance issues
  • Advising employers and employees on workers compensation claims and reviews
  • Representing individuals in the Medical Assessment Tribunals of WorkCover Queensland
  • Assisting employers to develop and apply workplace health and safety policies, and manage the rehabilitation of injured workers.

Our experience

  • Acted for members of the Queensland Teachers Union (QTU) and Queensland Independent Education Union (QIEU) in WorkCover claims for over two decades
  • Audited the Queensland Independent Education Union's policies against relevant workplace health and safety legislation and regulations, rewriting internal policies and procedures
  • Acting for an international timber corporation immediately following an incident that involved injury to an employee through negligent operation of a forklift, which resulted in a grievous bodily harm. This has avoided any prosecution to date and resulted in only an infringement notice being issued.
  • Acted for a construction company in seeking a review a decision to accept a WorkCover claim for an employee with a degenerative back condition, including obtaining additional factual evidence.
